The Vaginal Mesh Helpline is seeing an alarming increase in women and family members calling for both medical and legal help. The reported complications range from mild to very severe and some even life threatening. “They are all very similar”

says Lisa Spitzer MSW who speaks to most of the callers personally “The mesh was usually implanted to help strengthen a weakened pelvic floor” Says Spitzer ” In a women the pelvic floor consists of the bladder, bowel and Uterus, The vaginal wall is an intricate system of muscle and ligaments that can weaken from age, child birth or hysterectomy. Sometimes it is just poor genetics. Many women went in for a hysterectomy and came out with a mesh”” Doctors were lead to believe the mesh was the miracle answer”” very often the mesh was used for very mild SUI”” Women began having complications and infections when the mesh began to fail” The symptoms of a failed mesh which are reported to us include severe razor blade pain or pain that feels like child birth, pain on one side of the body, lower back pain, Spot bleeding, inability to have sexual intercourse, Increased incontinence or problems voiding, Bowel related symptoms or abdominal pain, difficulty sitting and infections.” ” It is important women understand they are not alone”” It is reported over 300,000 women have been implanted with mesh devices”We asked what is the mesh made of ” The mesh is made of a synthetic propylene fiber, a stretchy synthetic material.””When it falls apart and erodes it is very painful” She continues ” Women are angry at their Doctors”” many women are going back to the Doctors that put the Mesh in with no help”” They are being told it is all in their mind, just get used to it, We can try to trim it, It cannot be removed, we do not have your records any longer, try physical therapy, It is your fault for coughing, It is because you smoke and cough, get a colonoscopy, it is a tumor, and everything imaginable other then it could be the mesh failing. In October 2008 the FDA issued a warning regarding the vaginal mesh implants to Healthcare practitioners.

FL State App. Court Rules that Litigaiton Privilege does not Extend to Websites

After the plaintiffs filed suit against the defendants for (among other things) reach of contract, the defendants placed warnings to the public on their website stating that plaintiffs had violated certain trademarks. A memorandum on the defendants’ website stated that the plaintiffs were selling products and labeling them as D’Lites when they actually were not. The defendants’ website stated that “you need to know the product they are passing off as D’Lites Emporium ice cream is in fact a hoax.”

The Plaintiffs then amended the complaint claiming defamation. Disagreeing that a litigation privilege existed regarding the publication, the Court stated:

“We analogize the publication of statements on the internet to calling a press conference with the media or otherwise publishing defamatory information to the newspapers or other media. Other courts have
considered the issue of whether statements to a newspaper or other media are made in connection with a judicial proceeding. In Buckley v. Fitzsimmons, 509 U.S. 259 (1993), the Supreme Court held that a
prosecutor was not entitled to absolute judicial immunity for making defamatory statements at a press conference regarding a criminal prosecution, because comments to the press do not have any functional
tie to a judicial proceeding.”

The Court went on to note:

The website publication in this case was not made in  connection with the judicial proceeding. It was not made in the proceedings itself, nor was it made to a participant connected to the proceeding such as a witness. Like statements to the newspapers or press conferences, these statements have n o part in the judicial
proceedings. Instead, they were made to the world at large through the website and accused the plaintiffs of fraud and perpetrating a hoax on the public. These statements were not “necessarily preliminary” to
judicial proceedings, because unlike either Ange or Stewart the statements were not steps in the judicial process.”

About 6,350 lawsuits are now consolidated as part of the Yasmin and Yaz litigation before Judge Herndon in the U.S. District Court for the Southern District of Illinois. When Judge Herndon implemented the original bellwether program in October 2010, there were about 3,700 filed cases and the number of cases is expected to continue to grow as Yaz and Yasmin lawyers review and file additional cases.

All of the suits involve allegations that Bayer failed to properly research their birth control pills or adequately warn about the increased risk of serious and potentially life-threatening injuries from the birth control pills containing drospirenone, such as a stroke, heart attack, pulmonary embolism, deep vein thrombosis or gallbladder disease.

Yaz and Yasmin were the first birth control pills to contain drospirenone, a new type of progestin. Drospirenone impacts the body’s normal mechanism of regulating a balance between salt and water, which could result in elevated potassium levels. This can cause a condition known as hyperkalemia, which is linked to potentially life-threatening heart problems and other health issues.
